Minors are prohibited from using or possessing tobacco in public places within the city; the rule does not apply to a minor smoking or using tobacco at their own or their parents'/guardian's private residence.

• It is unlawful for anyone under 18 to use or possess tobacco "in any form" within the City of Pottsville, on City-owned property, or on any public street, highway, traffic way, alley, or sidewalk.
• "Tobacco" is defined as "a lighted or unlighted cigarette, cigar, pipe or other lighted smoking product and smokeless tobacco in any form."
• The article does not apply to a minor smoking or using tobacco in a nonpublic place that is the minor's residence or that of their parents or guardian.

Penalties

A violation is a summary offense; upon conviction, the penalty is a fine of up to $50.
